The case is the first appeal to the Supreme Court involving the 1996 Hague Convention on Child Protection. The issue is whether the Convention permits the English Court to order the summary return of a child to another contracting state if the child is wrongfully removed from that state to this country and, if so, when that power can and should be used. The Supreme Court has announced that the appeal is to be allowed and the case remitted for a re-hearing.
