Early Neutral Evaluation is an ADR approach that gives parties an independent and expert opinion on the merits of their case. While the evaluation is not binding, having a neutral expert opinion can greatly assist in narrowing or even resolving individual issues, or a whole case. By having an experienced specialist barrister objectively assess the case at an early stage, parties can gain an understanding of the relevant factors in their case – what might influence a decision in any further proceedings and the relative importance of any particular events or evidence. This evaluation enables clients to make informed decisions about whether and how to proceed.
We provide this service in all areas of family law, with specialists available for private law children matters, international children matters, and financial disputes.
Evaluations are usually conducted by joint instruction from both parties, where either an agreed set of facts is presented or each party is given the opportunity to submit a set range of documents. The barrister will then provide an expert evaluation, either through a meeting, including remotely by video or telephone, or through a written report. Evaluations can be produced by a single barrister, or by having two barristers look independently at a case before producing a joint report.
