  • Legal considerations: admissibility, the Court’s approach and the law of unintended consequences;
  • Practical considerations: questions that need to be asked, information that needs to be gathered; advice if a client raises the possibility of covert recording; and
  • Ethical considerations and the duty of utmost good faith.
