David Marusza, instructed by Siobhan Murray of Reeds solicitors, appeared for the Father in Re C (A Child) (Adoption by Foster Carers) [2024] EWFC 87 in a final hearing before Mr Richard Harrison KC, sitting as a Deputy High Court Judge.

The issues before the court were the Mother and Father’s opposition to a private agency adoption and what contact, if any, there should be with C if an adoption order were made, pursuant to the 2004 Act.

The judge decided that on a holistic consideration of the welfare options adoption was necessary and proportionate and that post-adoption contact was not in the best interests of the child due to her acute medical condition which meant any stress entailed a risk of death.
