In KN & Anor v RN & Ors [2023] EWHC 712 (Fam) Edward Bennett (instructed by Alison Leivesley of Bindmans) successfully argued that the court should recognise Nigerian adoptions at common law on the grounds that, in circumstances where the criteria for recognition set out in Re Valentine’s Settlement were not met for one of the children, to not grant recognition would constitute a disproportionate interference in the adoptive parents’ and children’s Article 8 rights. 

This may be only the second reported instance that the court has been prepared to take such a step, and the first in eight years.
