Edward Bennett, instructed by Aramas International Lawyers, represented the successful Applicant father in DL v BJ [2024] EWHC 2160 (Fam);  an application under the inherent jurisdiction for the summary return of N, his one-year-old child, to Dubai in the United Arab Emirates. 

The family left the UK to live permanently to Dubai in December 2023. N was abducted to England by his Filipino mother in April 2024. The mother expressed vague plans to move back to the Philippines with N. 

The court found that at the time of the abduction N had been habitually resident in Dubai. The court ordered N’s return. N’s mother is to remain his primary caregiver in Dubai. The UAE courts will, in the absence of agreement, make substantive decisions about N’s long-term welfare, the arrangements for his care and the country in which he spends his childhood.
