Edward Bennett successful in the Court of Appeal in N & A (1996 Hague Convention: Article 13) [2023] EWCA Civ 623

9th Jun 2023 | News, Cases

Edward Bennett, instructed by Goodman Ray, represented the successful Appellant father in N & A (1996 Hague Convention: Article 13) [2023] EWCA Civ 623, an appeal from an order relating to return of children to this country, whilst corresponding measures had been requested from the authorities of Ukraine. This case is believed to be the first occasion where the Court of Appeal has considered Article 13 of the 1996 Hague Convention. The Court of Appeal also made some interesting observations regarding appeals not being academic where there is the possibility of an English order being recognised or enforced in a foreign jurisdiction.
