After a successful Court of Appeal challenge and a re-hearing at which the court ordered the child’s return to England and Wales from Zambia, this judgment is the latest in Edward and Rob’s, instructed by Field Seymour Parkes, on-going case of J v E. This important fact-finding hearing established that the father, represented by Edward and Rob, was the victim of significant domestic abuse perpetrated by the child’s mother, and that her allegations of sexual abuse by him of their child were not proven.

The case highlighted particular challenges of conducting a fact-finding when some of the alleged incidents happened in a foreign country, but showed that the English court can do so and make robust findings where the evidence justifies it. The important findings made by the court in this judgment now pave the way for final welfare decisions.
