Jason Green was instructed by Abbey Solicitors for the Applicant father in G (A Child), Re (Habitual Residence) [2026] EWHC 1427 (Fam); a technically demanding cross-border jurisdiction dispute.
This case concerned a complex international children law dispute involving a child with connections to England, Pakistan and the United Arab Emirates. The father sought the return of his young daughter to England and Wales under the court’s inherent jurisdiction, contending that she remained habitually resident here despite having lived abroad since March 2024.
The court was required to undertake a detailed analysis of habitual residence and jurisdiction where neither Pakistan nor the UAE are parties to the 1996 Hague Convention. The case involved competing arguments regarding the child’s integration, the effect of prolonged absence from England, and the significance of her residence in multiple jurisdictions.
