Jason Green, instructed by HMG Law, represented the successful Applicant mother in MC v FG (Relocation) [2024] EWFC 204 (B); an application by mother for permission to relocate with children to a foreign country.

The law governing this case is outlined in Section 1 of the Children Act 1989, which mandates that any welfare assessment must consider the factors listed in the welfare checklist under Section 1(3).

The mother and children relocated to England from country Y 18 months prior and, despite the children settling well and thriving at school, the court concluded that the children’s welfare needs were best met by relocating back to country Y because of the children’s established connections and previous stability in country Y. Permission granted.
