16th Jan 2023 | News, Cases

Aidan and Mavis appeared for the respondents in the Court of Appeal decision of Re C (Surrogacy: Consent) [2023] EWCA Civ 16, an appeal by surrogate & biological mother against parental order, on the ground that she had not given free & unconditional consent. This appeal examined the principle of consent in surrogacy cases and considered, for the first time, the consent requirements of s54(6) of the Human Fertilisation and Embryology Act 2008. An opinion piece was reported in the Family Law Journal.
