Aidan, instructed by Daniells Family Law Ltd, led Victoria Hoyle in J (Children: Reopening Findings of Fact) [2023] EWCA Civ 465. Aidan represented A in this appeal by A’s younger siblings’ father (F2), against a decision to reopen findings of fact made in relation to child welfare proceedings which involved allegations of sexual assault made by A against F2. F2 appealed this decision after having been found not guilty after trial in the Crown Court. The Court of Appeal considered the correct approach to be taken in such cases, emphasising the importance of fairness and the need for a careful balancing of the interests of all parties involved. Ultimately, the court found that the decision to reopen the findings of fact was justified in the circumstances and dismissed the appeal. Reported in Local Government Lawyer.
