Edward Bennett in K v E [2023] EWHC 2890 (Fam)

16th Nov 2023 | Cases

Edward Bennett, instructed by Freemans Solicitors, represented the respondent mother in K v E [2023] EWHC 2890 (Fam) and successfully resisted the father’s application for the child’s summary return to Germany. Edward succeeded on a number of heads. Firstly, that the father had consented to the move to England. Secondly, that there would be a grave risk of harm to the child were a summary return ordered (decline of mother’s mental health and the risk of domestic abuse towards herself and the child).
