Jason Green, instructed by Broadway Solicitors, represented the First Respondent Mother in F v M & Anor [2025] EWFC 454 (B); a fact-finding in private law proceedings, concerning father’s allegations against mother, including that she had engaged in alienating behaviours.

Following their separation in early 2023, Father issued a C100 and C1A alleging that Mother was controlling, obstructive and had engaged in alienating behaviour. The proceedings drifted, with multiple DRAs, therapeutic input and, problematically, a “global” psychological assessment ordered before any factual matrix had been determined, contrary to later case law and the December 2024 FJC Guidance. The judge found the expert report of limited weight because it was commissioned at an inappropriate stage and strayed into fact-finding.

At the hearing, Jason undermined the alienation narrative by cross-examining Father into the following key concessions: the child had missed only six contact days (all illness-related); there was ongoing time with Father; and some complaints (e.g. extracurricular activities/choir, school talk) were not borne out. Jason also highlighted that the child’s reluctance to see Father could be explained by chronic parental conflict, differing routines and parenting styles, and mismanagement of anxieties rather than manipulation. 

The court found that the child’s difficulties were multifactorial, rooted in conflict and poor adult communication, not deliberate psychological manipulation.
