Nick Goodwin KC was instructed by Vardags for the 1st Respondent father in AB v CD [2025] EWHC 1563 (Fam); an application by mother for one child to be returned from Egypt to England and by father for other child to be returned to Egypt from England.

This hearing concerned cross applications by the parties for the summary return of their two children after the mother removed the youngest child from Egypt. The father sought to have both children reunited in Egypt, claiming the mother had abducted the youngest, arguing jurisdiction and welfare concerns.

The court considered the jurisdictional basis for making return orders, specifically under sections 2 (1) and (3) of the Family Law Act 1986 and the Hague Convention 1996.

The court acknowledged the complexity of cross-border family disputes and noted the need for a thorough welfare analysis before making final orders. Trowell J refused both parents’ applications for summary return and listed the case for a final welfare hearing.
