Nick Goodwin KC led Louise Higgins, of No.5 Barristers’ Chambers, they represented the First Respondent Local Authority in R v S [2025] EWHC 1791 (Fam); care proceedings concerning a child of parents with learning difficulties.

This case concerned a four year old girl (H) born to parents with learning difficulties. The parents required a high level of support to achieve an acceptable level of safety for H.

A comprehensive, collaborative care plan was approved by the court, allowing H to live with her parents under a structured support system provided for both parents and H.

This approach aligns with the principle that avoidance of removal is preferable and possible where augmented, targeted help is able to bridge the gap in care caused by the parents’ limitations.
