Oliver Wraight and Matthew Stott in The London Borough of Lambeth v RF & Ors [2024] EWFC 257 (B)

Oliver Wraight, instructed by Elizabeth Eigbefoh of Francis Solicitors, appeared on behalf of the Second Respondent and Matthew Stott appeared on behalf of the Applicant Local Authority (LA) in The London Borough of Lambeth v RF & Ors [2024] EWFC 257 (B); Care proceedings, issued following concerns over parenting.

This case concerned two brothers aged 11 and 8. In the 15 months before proceedings were issued the boys were on Child Protection Plans because they were not going to school regularly, missing medical appointments, there were concerns about the boys being left at home alone, the family home was said to be in disrepair, there were rent arrears putting the family at risk of eviction and there were further concerns about the mother’s mental health, drug use and a violent outbursts.

In April 2023 interim supervision orders were made for both children and Child Arrangements Orders were put in place for the boys to live with their father. The older boy kept absconding and soon afterwards went to live with his grandmother. The younger boy remained living with his father until January 2024 when he made allegations about his father instigating police protection. Both boys eventually moved to live with their maternal grandmother.

At the final hearing, both  children remained with their maternal grandmother under Special Guardianship Orders. Neither boy had seen their father for 8 months so indirect contact only with their father was directed but which may eventually lead to direct contact.
