Professor Rob George KC led Natasha Miller in a significant new Court of Appeal decision regarding habitual residence in child abduction proceedings. Re F (A Child) (Habitual Residence) [2025] EWCA Civ 911 concerned a child retained after five months of being in England, having previously lived in Colombia. The Court of Appeal held that neither party bears a burden of proof in relation to habitual residence and issued new summary guidance on how to approach an assessment of where a child’s place of habitual residence lies. This case is essential reading and is now the leading authority in this area. Professor Rob George KC and Natasha Miller were instructed by Dawson Cornwell.
