Ruth Cabeza recently joined a distinguished panel of family law specialists for a webinar examining the use of expert evidence in international child abduction proceedings. Hosted by 4PB and the Child Abduction Lawyers Association (CALA), and chaired by Mani Singh Basi, the webinar brought together leading practitioners to discuss the practical and procedural challenges surrounding expert evidence in international child abduction cases.
Drawing on her extensive experience in Hague Convention cases, Ruth shared practical guidance on applications for expert evidence, including mental health assessments under Article 13(b), highlighting the importance of early case preparation, identifying appropriate experts and ensuring applications satisfy the statutory test of necessity. She also discussed the effective use of expert evidence at trial, including the distinction between seeking clarification from an expert and challenging their conclusions through oral cross-examination.
The webinar provided valuable practical insights into the effective use of expert evidence in complex international children proceedings.
