This case concerns the care of 4 children. The Local Authority bought proceedings on 8th February 2023 due to concerns that all 4 children were suffering or at risk of suffering significant harm. The application considers that the children were suffering or at risk of suffering significant physical and emotional harm as well as neglect attributable to the care given to them by their parents.

The Local Authority has made an application to the court for a Care Order for each of the 4 children and seeks Placement Orders for the youngest 3 children.

James Turner represents the Mother, who has throughout the hearing made it clear that although she is not currently in a position to care for the children herself, she wants the court to make the best decision for the children individually and as a sibling group. She is seeking support and wants to work towards caring for the children and being a part of the children’s life.

The judgment looks at threshold from paragraph 69 but considers the relevant law in this area from paragraph 49.

The court makes findings of domestic abuse against the Father and extends the Non-Molestation Order in favour of the Mother. The court are in agreement with the children’s guardian that a more extensive care plan needs to be submitted before a final decision is made.
