John Vater KC led Hannah Mettam, instructed by Jackson West, represented the Second Respondent and Aidan Vine KC led Chris Watson of St Philips Chambers, instructed by Penmans, represented the First Respondent in X (A child), Re [2023] EWFC 264 (B) an application by a local authority for permission to withdraw care proceedings.  Child X was removed into care after presenting with ‘a shaking type of injury’.  The parents maintained that the injury occurred while X was playing in a cardboard box at a party. Witnesses maintained the same. Medical experts testified that intracranial injury in the form of subdural haemorrhage can occasionally result from a short fall. The court found that the parents were not culpable for X’s injury and permission to withdraw the care proceedings was granted.
