John Vater KC, leading Charlene Henderson of 7 Bedford Row, was instructed by Kundert Solicitors to represent the Second Respondent Father and Hannah Mettam, leading Andrew Duncan of 3 Paper Buildings, was instructed by Sills & Betteridge to represent the Children’s Guardian in Re CM (A Child) [2023] EWFC 263 a fact-finding in care proceedings regarding the cause of injuries to an infant called CM. CM sustained eight factures within a month of being born and 11 in total before being placed in care. The court found that the fractures had occurred at different times based on the varied rates of healing. The court found no evidence of any underlying metabolic bone disease or abnormal bone density. The court also found that the injuries had been sustained non-accidentally. While the court was unable to make findings as to which individual perpetrated the injuries, it was found that both the mother and father, the only possible perpetrators, had concealed the truth from the Court.
