Nick Goodwin KC, instructed by Talbots Law, acted on behalf of the child, successfully supporting the appellant mother, in M (Care Order: Risk: Family Placement) [2025] EWCA Civ 163; an appeal against a care order, predicated on the child’s removal to the grandparents’ care. The father was a sex offender with whom the mother had originally hoped to maintain a relationship. During the final hearing she indicated, for the first time, that she wished to move on with her life and separate. The judgment at first instance did not allow her the opportunity to demonstrate she had severed her emotional ties to him or that she could successfully undergo therapy, despite the subject child’s age (relative to the age of the father’s victims) meaning that he was unlikely to pose an acute risk of harm to her for some years. The care order was set aside and the case remitted.
