Professor Rob George, instructed by Dawson Cornwell, acted for the applicant mother in E & F (Stranding) [2024] EWHC 2901 (Fam); a case of transnational spousal abandonment, more commonly termed ‘stranding’. Rob successfully obtained findings from the High Court on six counts of domestic abuse, including the key finding that his client and the children had been ‘stranded’ in Pakistan when the husband took them there, under false pretences, and then removed their travel documents from them to prevent their return to the UK. Rob further obtained declarations from the court that it retained jurisdiction over the children, despite there being on-going proceedings in Pakistan, and obtained orders for the children’s return. This is a case invoking the UK-Pakistan Judicial Protocol on Children Matters 2003, aiming to persuade the judges dealing with the Pakistan proceedings to give full weight to the English High Court’s judgment in the context of that bilateral agreement.
