Simon Miller and Elisabeth Wickham were instructed by the Applicant Local Authority in London Borough of Lambeth v M & Ors [2025] EWFC 55 (B); care proceedings issued following a five year old child presenting at hospital intoxicated through consumption of the drug Topiramate.
This case concerned the welfare of four children; A, B, C, and D, amid concerns of medical neglect. The proceedings were initiated after C, then five years old, was taken to hospital by Mother, after a delay. C presented with; hallucinations, randomly urinating, intermittent crying, vacant episodes and rolling eyes. Tests revealed intoxication through Topiramate, an anticonvulsant medication, which had previously been prescribed for A. C had also presented at the same hospital with an overdose of Topiramate a year earlier.
It could not be proved that Mother had directly administered Topiramate to C. Despite unresolved concerns, the court acknowledged the strong bond between Mother and her children. The court adjourned the welfare aspect of the case to allow for a comprehensive analysis of all available options. A multi-disciplinary team will be formed to consider the implications of the proposed care plan and assess the potential for the children’s return to Mother’s care.
