Vicky Reynolds was instructed by local authority and David Marusza was instructed by Brethertons for the mother in Re A (care – judgment on appeal) [2023] EWFC 84. This case was an appeal by a local authority against the dismissal of an application for a care order. The local authority sought care and placement orders in respect of A (a young boy) following a violent assault by father on mother, after which mother was diagnosed with a brain aneurysm. HHJ Vincent agreed with the District Judge who had found that it would not be in A’s welfare interest to make an order that would place A with strangers whilst the option of him being brought up within his family was still viable. Appeal dismissed.
