Nick Goodwin KC and Damian Broadbent in KCC v M & Ors [2026] EWFC 60 (B)

31st Mar 2026 | Cases

Nick Goodwin KC led Damian Broadbent in KCC v M & Ors [2026] EWFC 60 (B). They acted for the Applicant Local Authority in an eight-day fact-finding and welfare hearing which concerned C, aged three. The local authority sought care and placement orders, supported by the guardian, while the parents sought C’s return. The court examined serious allegations, including historic sexual abuse by the father, which were ultimately not proven, though not found to be false. Significant concerns remained regarding both parents’ ability to meet C’s needs, including developmental delay, health management, unstable home conditions, and lack of insight. The court found C would face a risk of emotional and physical harm in their care. Threshold was satisfied, and care and placement orders were made as necessary and proportionate.
