Emma Gatland appeared in the Court of Appeal today in one of three conjoined appeals

17th Jul 2025 | Cases

Emma Gatland appeared in the Court of Appeal today, led by Sam Momtaz KC, for directions in one of three conjoined appeals, dealing with legal parentage. The Court of Appeal will consider the impact of a declaration of non-parentage in the case of a man not married to the child’s mother, who is named on the child’s birth certificate but who is subsequently proved not to be the child’s biological father.

Questions likely to arise are whether the individual actually acquired parental responsibility at all, whether his PR (if he had it) can only be removed by order of the court and if so whether a welfare analysis is required. King LJ, today, described the three appeals as “difficult and very significant”.

Alana Hughes will act as second junior counsel as the case is prepared and at the appeal hearing later this year, together with Emma.
